Introduction

These Terms and Conditions ("Terms") govern your use of AI Fusion's services, including but not limited to our AI-powered rendering tools, design marketplace, and collaboration platform (collectively referred to as the "Service"). By accessing or using the Service through our website at fusiontools.ai or any associated applications, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue your use of the Service.

1. Definitions

The following terms shall have the meanings ascribed to them throughout this agreement:

"Service" refers to all features, tools, and functionalities provided by AI Fusion, including AI rendering, staging, marketplace, and collaboration tools.

"User Content" means any images, designs, text, or other materials uploaded or submitted by you to the Service.

"AI Outputs" are the renders, designs, or other content generated by AI Fusion based on your User Content.

"Marketplace" denotes AI Fusion's integrated platform that connects designers, suppliers, and clients.

"Subscription Plan" indicates the selected pricing tier (Free, Pro, Team, or Enterprise) that governs your access to the Service.

2. Account Registration and Eligibility

To use the Service, you must create an account by providing accurate and complete registration details. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. AI Fusion reserves the right to suspend or terminate accounts that provide false or misleading information.

Individuals must be at least 18 years of age or have the consent of a legal guardian to use the Service. Businesses and organizations must ensure that the person registering the account has the authority to bind the entity to these Terms.

3. Subscription Plans and Payments

AI Fusion offers several Subscription Plans to accommodate different user needs. https://fusiontools.ai/dashboard/payment The Free Tier provides access to basic features but includes watermarked renders and limits on daily generations. The Pro Plan offers high-resolution renders and faster processing for commercial use. The Team Plan enables multi-user access and shared workspaces, while the Enterprise Plan includes custom service-level agreements, API access, and dedicated support.

Subscription fees are billed on a recurring basis and will automatically renew unless canceled at least seven days before the renewal date. Accepted payment methods include credit/debit cards, PayPal, and, for Enterprise customers, approved invoicing arrangements. Refunds are generally not provided for partial billing cycles, except where required by applicable law.

You may upgrade or downgrade your Subscription Plan at any time, with changes taking effect at the start of the next billing cycle. Cancellation of your subscription will stop future charges but does not entitle you to a refund for any unused portion of the current billing period.

4. Acceptable Use and Restrictions

The Service is intended for lawful purposes, including design visualization, architectural rendering, product mockups, client presentations, and marketing materials (subject to the terms of your Subscription Plan). You may also use the Marketplace to source materials and connect with suppliers.

Prohibited activities include generating illegal, deceptive, or harmful content; reverse engineering or exploiting AI Fusion's systems; engaging in impersonation, spam, or fraudulent Marketplace transactions; and any other actions that violate these Terms. Violations may result in immediate account termination and legal action.

5. Intellectual Property Rights

You retain all ownership rights to the User Content you upload to the Service. By using the Service, you grant AI Fusion a non-exclusive, worldwide license to process your User Content solely for the purpose of generating AI Outputs.

AI Outputs generated under the Free Tier may include watermarks and are restricted to personal, non-commercial use. For paid Subscription Plans, you own the AI Outputs, provided you comply with these Terms. AI Fusion retains all rights to its software, algorithms, and user interface, and no additional rights are granted except as explicitly stated herein.

6. Data Privacy and Security

AI Fusion processes User Content only to provide the Service and does not use it for AI model training without your opt-in consent. Personal data is handled in accordance with our Privacy Policy, which outlines our practices for data collection, storage, and protection.

The Marketplace may involve interactions with third-party suppliers and clients, each operating under their own terms and policies. AI Fusion is not responsible for the actions or omissions of these third parties.

7. Data Ownership

User Content Ownership

You retain all right, title, and interest in and to any User Content (including but not limited to images, designs, or materials) that you upload or submit to the Service. By providing User Content, you grant AI Fusion a non-exclusive, worldwide, royalty-free license to use, process, reproduce, and display such content solely for the purpose of:

  • Providing the Service (e.g., generating AI renders or facilitating Marketplace transactions);
  • Improving our AI models only if you explicitly opt-in through your account settings; and
  • Complying with legal obligations.

This license terminates automatically when you delete the User Content from our systems or upon account closure, except where retention is required by law.

AI-Generated Outputs

For Free Tier users, AI Fusion retains a limited license to display watermarked outputs for promotional purposes. You may use these outputs only for personal, non-commercial purposes.

For Pro, Team, and Enterprise subscribers:

  • You own all AI Outputs generated from your User Content, subject to compliance with these Terms.
  • You may use outputs for commercial purposes (e.g., client presentations, marketing materials).
  • AI Fusion retains no rights to your outputs unless you voluntarily opt-in to share them for model improvement.

Prohibited Uses

You may not claim ownership over:

  • AI Fusion’s pre-existing materials (e.g., default textures, templates, or assets in our library);
  • Outputs generated from another user’s content or third-party copyrighted material without authorization; or
  • Generic elements of renders (e.g., lighting algorithms, AI-trained design patterns).

Marketplace Contributions

Content shared in the Marketplace (e.g., supplier product catalogs) remains owned by the original contributor. By posting, you grant other users a license to view and use the content only within the Service.

8. Marketplace Terms

Suppliers listed on the Marketplace are vetted but not endorsed by AI Fusion. Users are encouraged to conduct their own due diligence before engaging in transactions. All purchases, including materials and staging services, are agreements solely between users and suppliers. While AI Fusion may assist in dispute resolution, it is not obligated to do so.

9. Termination and Suspension

You may cancel your account at any time through the account settings. AI Fusion reserves the right to suspend or terminate accounts for violations of these Terms, fraudulent activity, or prolonged inactivity. Upon cancellation, your User Content will be retained for 30 days before permanent deletion.

10. Disclaimers and Limitation of Liability

The Service is provided "as-is," without warranties of accuracy, uptime, or fitness for a particular purpose. AI Outputs may contain errors or unexpected results.
AI Fusion's liability is limited to the amount paid by you for the Service in the 12 months preceding any claim. We are not liable for indirect damages, such as lost profits or reputational harm.

11. Modifications to Terms

AI Fusion may update these Terms with 30 days' notice, provided via email or in-app notification. Continued use of the Service after such changes constitutes acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of [Insert Jurisdiction, e.g., Delaware, USA]. Disputes must first be submitted to arbitration before pursuing litigation, except for claims requiring injunctive relief.

Service Level Agreement (SLA)

1. Service Availability

AI Fusion guarantees that the Service will be operational and available to users at least 99.5% of the time during each calendar month ("Uptime Commitment"). This commitment applies to all paid subscription tiers (Pro, Team, and Enterprise). The Uptime Commitment excludes scheduled maintenance windows, which will be announced at least 48 hours in advance, and any unavailability caused by circumstances beyond our reasonable control, including but not limited to force majeure events, third-party service failures, or user-side connectivity issues.

2. Performance Standards

For paid subscription tiers, AI Fusion agrees to the following performance benchmarks:

  • AI rendering requests shall be processed within 60 seconds for standard resolution outputs (under normal system load).
  • User Content uploads shall maintain a minimum throughput of 10 Mbps per connection.

3. Support Response Times

AI Fusion provides technical support according to the following service tiers:

  • Pro Users: Email support with a response time of 24 business hours.
  • Team Users: Priority email and chat support with a response time of 12 business hours.
  • Enterprise Users: Dedicated 24/7 support with a maximum response time of 4 hours for critical issues (defined as complete Service unavailability).

4. Remedy for SLA Failures

In the event that AI Fusion fails to meet the Uptime Commitment in any given month, affected paid users may request a service credit equivalent to 5% of their monthly subscription fee for each full percentage point of downtime below the guaranteed threshold, up to a maximum of 50% of the monthly fee. To qualify for credit, users must submit a written request toclientsuccess@fusiontools.aiwithin 30 days of the incident, including documented evidence of the Service interruption.

5. Exclusions

This SLA does not cover:

  • Performance issues related to user equipment, internet connectivity, or third-party services not under AI Fusion's direct control.
  • Downtime during beta testing of new features or free-tier usage.
  • Any unavailability resulting from user violation of the Terms of Service.

6. Monitoring and Reporting

AI Fusion maintains comprehensive system monitoring to track Service availability and performance. Enterprise clients may request monthly uptime reports, which will detail incident timelines, root cause analyses, and corrective actions taken.

7. Modification of SLA Terms

AI Fusion reserves the right to amend this SLA with 30 days' prior notice to users. Material changes will be communicated via email and in-service notifications. Continued use of the Service after such notice constitutes acceptance of the revised terms.
